The Timing of IPCE, PCE, Final May,11 was earlier 9:00 AM to 12:00 PM Which is now shifted to 2:00 PM to 5:00 PM (IST) by ICAI.

Income Tax Arrears 2 Lakhs Crore Approx.

Income Tax Arrears Total . 2,48,927 Crore: FM The total income tax arrears in the country stood at. 2,48,927 crore on April 1, 2010, and the Central Board of Direct Taxes (CBDT) has been tasked to monitor all outstanding dues of above . 10 crore, Parliament was informed on Tuesday. In a written reply in the Rajya Sabha, Minister of State for Finance S S Palanimanickam said the total outstanding arrears which stood at . 2,13,646 crore as on April 1, 2009, increased to . 2,48,927 crore at the start of the current fiscal.

Proposal to Changes in Rotation of Auditors Norms Company Bill

In what could be a breather to India Inc, the corporate affairs ministry is proposing diluting norms for rotation of auditors and audit firms for companies in the new Companies Bill. The bill will be taken up for consideration in Parliament in the ongoing Budget session.
In Clause 123 (1A) of the Companies Bill, the ministry stipulates that no company can appoint or re-appoint an individual or a firm as auditor for more than five consecutive years. “The provisions of mandatory rotation of auditors and audit firms will stay, although the five-year period for rotation (of auditors) may be relaxed. Industry did have issues with rotating auditors and audit firms every 5 years but we are working out a more acceptable time frame,” a senior MCA official said.
Although the provision for rotation of auditors was approved by the Parliamentary Standing Committee on Finance that had earlier scrutinised the Bill, it did not find favour with the industry.
The industry argued that it takes years for an auditor to understand a large company and hence change of auditors after five years is not desirable. The official further said, “although industry is largely divided on the stipulations, the consensus is emerging that although rotation should be made mandatory, it should be for an increased time period”. The Parliamentary Standing committee has noted that rotation of audit partners and audit firms should be considered especially in the light of the Rs 14,000-crore accounting fraud at Satyam Computer, whose founder confessed of having cooked the books of the company for over seven years.
Ever since, the audit profession itself has come under public eye, prompting the government not only to impose stricter provisions for appointment of statutory auditors, but also to ensure that the process of statutory audit and the functioning of auditors are truly independent and effective.

Writing Answers in IPCE,PCE,FINAL

As we all know that these days, our papers are based entirely on case studies. We read in almost every message from our president, vice president and chairman of Board of Studies that our exams are going to be more and more practical oriented. In Law, Audit, Taxation, Accountancy there are many questions are based on case laws/practical situations. Therefore it becomes imperative to know “How to answer a case law”.

If we answer the case laws in a logical and coherent manner, it’s indeed easy to get marks.

I share my experience with all of you. While preparing for my PCC exams, I spent a huge amount of time in studying and analyzing Board of Studies publications (Study Materials/Modules, Compilations, Suggested Answers, Revision Test Papers, Practice Manuals and Model Test Papers) and finally I could come out with something very crucial and essential. I have attempted to prepare a synopsis of my observations.

In my view, this technique should be followed to answer a case study oriented question:-

1st Paragraph:-

When you read the question, try to recall the relevant provisions/sections of law/Act.
In the 1st paragraph you have to write those provisions of law on which the question is based. In case of questions based on Accounting Standards, you have to write the relevant extract/matter of the Accounting Standard. And if you can also mention the paragraph number of Accounting Standard, do mention it. It makes a very good impression.


Many a times, the question is based on a specific case law
E.g. In Contract Act - Balfour vs. Balfour
In Companies Act-Saloman vs. Saloman & Co. Ltd.

In these kinds of questions, our answer remains incomplete till we don’t cite that particular case law

The aforementioned case laws are landmark case laws which have set some principals. Starting your answer with these kinds of fundamental principals and correlating them to the pertinent sections/provisions, which you are going to mention in your answer, depicts your understanding of the law.

So, in these kinds of questions, you can directly start your answer with a reference to that particular case law, provided you remember it. It will show that you have correctly interpreted/understood the question and the examiner will certainly get impressed.
Mentioning the correct case law will surely fetch you high marks.
If you don’t cite a case law, your marks won’t be deducted. But if you mention a wrong case law, your marks will be deducted.

Your answer should start like this if you remember that particular case law. The very first line should be” The question is based on the principals set in the case of ____”

Your answer must start like this if you remember the section number
“As per Sec.___of _____Act, ___ (year) “
And your answer should start like this in case you do not remember the section number
“As per the provisions of ____Act, ___ (year)”

Never write wrong section number and never mention a fake/imaginary case law because the examiner is not a fool. If you do this, he/she may get angry and you can be the sufferer. Case laws and section numbers should form part of your answer only when you are confident about them. Be extremely cautious about it.

2nd Paragraph:-

In the 2nd paragraph, write the facts and circumstances of the given case. Write, what is given in the question.
Your wordings can be-
“In the present case” or “In the given case” or “In the instant case”

3rd Paragraph:-

Finally, you have to arrive at a decision by comparing 1st paragraph and 2nd paragraph i.e. what is written in law and what is the present case. This is the most important part of the answer.

You should make a right decision.

Support your decision with a case law, if any. This is crucial. Quoting an appropriate case law strengthens the quality of answer and makes the answer elegant and complete. Mentioning a relevant case law also justifies the reached decision.

In nutshell, this is how your answer should be presented:

1st Para: Relevant Provisions/Sections and Fundamental principles (You can straight away start your answer with a case law in some cases)

2nd Para: Facts and circumstances of the given case

3rd Para: Analysis, Decision and Conclusion with a case law, if any.


So this is the manner in which a professional examination question must be answered. If you follow it, you will definitely score high.


Some Good Tips

1. Quoting section numbers and case laws are absolutely necessary to secure full marks. Don’t think that it’s not required at IPCC/PCC/PE-II/Intermediate level.
You can see the suggested answers/compilation. They do quote section numbers and case laws in almost all answers.

2. A good command over English is also a pre requisite for writing a quality answer.

3. Go through the Suggested Answers/Compilation to become familiar with this kind of writing style.

4. In Law, it is the writing style that matters the most and helps in fetching marks. Almost all students know the answer but they don’t know how to present the answer. If we are asked to answer a question in terms of yes/no, we can easily answer. But elaborating that same answer, using the phrases/words of statute/law, drafting the answer in a nice order are the areas where students are lacking. So fine tune your writing style.

5. Law has its own language. We can’t write the answer in general English. Most of the students think that even if they write the answer in general language, they will get marks but it is not so. Language of statute differs significantly from general English in certain circumstances/cases. Law has certain phrases, certain words, we need to learn them and reproduce them in our answers. Try to learn the language of law. Otherwise it becomes a bit difficult to score high.

6. Make a habit of referring to the bare Acts. It will facilitate better understanding.

7. Please read the examiners’ comments on students’ performance (given at the end of suggested answers) to get an insight about what the examiners want us to write, what they are expecting from us and what are the mistakes which students generally commit. And then avoid doing those mistakes and try to improve on those areas.

8. Law is a scoring paper. And it becomes easier to score when the paper is case study oriented. Because we can’t remember the complete section but we can recall a part of the section and reproduce the same in our answer. If the question paper has flat questions which simply require writing a complete section in the answer, we can’t score as high as we can in case studies oriented paper.
So don’t think that it is tough to score when the paper is case study based.

9. Even if your answer is incorrect i.e. the decision at which you have arrived is not right, you won’t get zero marks. You will be given due credit if you have written the correct provisions and facts of the case.

10. In Auditing, there are certain words/group of words which are used quite frequently like” Sufficient Appropriate Audit Evidence”, “Nature, Time and Extent of Audit Procedures to be performed”, “Material misstatement”, “Compliance and Substantive Procedures” etc. So these words have to be mugged up. In Auditing there are three leading case laws:

a) In Re Kingston Cotton Mills (Responsibility of Auditors)
b) London and General Bank (Responsibility of Auditors)
c) Chantry Martyn vs. Martyn (Ownership of Working Papers)

Keep these case laws in mind and write them if something comes on the above topics.

If possible, read Company Audit from the bare Act because in the module and other reference books the topic is given in a very scattered manner. If you read bare Act once and then read the module/reference book, you will be able to grasp it pretty quickly and since company audit holds a great significance in terms of marks, I strongly recommend you to refer to the original Act. You need to read only 6-7 pages of the bare Act to finish Company Audit and I think you should go for it.

11. Never think that the papers are lengthy and not manageable. I assure you that if you know the solutions of all the questions, you will definitely complete the paper well within time because when you know the solution, you won’t take time to think. The only thing required to attempt the paper quite comfortably is that you must know the solutions and for that all your efforts ought to be directed towards systematic studies.


12. You can follow this technique for Taxation, Audit and Accounting Standards also.

13. Take time to read the question. Understand it properly. Law is all about interpreting, analyzing and then applying the mind judiciously to handle practical situations. So understand the law properly.

No Forex Trade For Individual - RBI Says

The Reserve Bank today said resident Indians cannot trade in forex market as per the existing regulation. 

The existing regulations under Foreign Exchange Management Act (FEMA), 1999, do not permit residents to trade in foreign exchange in domestic or overseas markets, RBI said in a statement.

Idea Cellular got Fined Rs. 300 Cr. ,Could come to End

Idea Cellular may lose overlapping mobile permits in six regions and could end up paying a fine of Rs 300 crore if the telecom department accepts the recommendations of a top law officer of the government. 


Additional Solicitor General Amarjit Singh Chandhiok said in his legal opinion dated February 15 that Idea violated laws by holding more than 10% stake in two mobile companies operating in the same regions.

Tips for sitting for long hours Studies !!

General Posture
Make sure you adopt these good posture habits whether you're sitting in the cafeteria or at your desk.
  1. Fill in the space between your back and the back of the chair: When sitting in a chair, sit straight so that the space between your lower back and the chair is no longer existent.
  2. Keep your tummy relaxed: Don't contract all of your muscles when you sit down. You can rely on the chair to help you with your posture without tightening your tummy.
  3. Keep your neck, back and heels aligned: If you draw an imaginary vertical line down your back, your neck and heels should hit in the same spot, too.
  4. Keep your feet flat on the floor: Make sure you keep your feet flat on the floor when you're sitting at your desk.
  5. Sit down: Instead of sitting up, sit down, letting your chest relax down, but not over.
  6. Tuck in your chin: When standing, keep your head straight but your chin tucked in to keep your neck stable but not overexerted.
  7. Keep your knees at a 90-degree angle when sitting: Remember to keep everything aligned. Don't tuck your knees in, which can make you start to hover and hunch over your keyboard.
  8. Draw your shoulders back and relax: Draw your right shoulder, then your left shoulder back and then down, and then take a deep breath and relax. After working for several minutes, monitor the position of your shoulders, and make sure you're not hunched over.
  9. Align your hips with the base of your chair: Tuck your tummy in and sit so that your hips are touching the base of your chair back.
  10. Evenly distribute your weight: You shouldn't lean over to one side when you sit: you should distribute your body weight evenly between both hips.
Computer and Keyboard
When you're researching, writing papers, or playing on Facebook, be aware of how your body should be aligned to prevent injury and strain.
  1. Use a chair with a flat surface and straight back: This type of chair will support your back while you work at the computer.
  2. Place your ankles underneath your knees: When you sit, make sure your ankles line up underneath your knees for proper posture and balance.
  3. Your monitor should be at eye level: This is one of the most important tips to keep your posture in order. Adjust your chair and get the right desk so that the top of your monitor is at eye level.
  4. Align your wrists with your forearms: Keep your wrists in line with your forearms instead of bending them up or down, which causes great stress on the muscles and tendons.
  5. Bend your head slightly forward: Keep your head bent slightly forward and aligned so that you're looking at your monitor straight on.
  6. Use a document holder: To prevent twisting your neck and body, use a document holder next to your monitor if you're making a transcription.
  7. Keep your elbows close to the body: Experts recommend that elbows should be bent between 90 and 120 degrees.
  8. Turn your whole body, not just your neck or mid-section: When you are sitting in a swivel chair, it's best to turn your whole body instead of just straining your neck or mid-section.
  9. Take advantage of armrests: Armrests will help you relax your shoulders and keep elbows close to the body.
  10. Use a wrist rest: Use a wrist rest on your keyboard and on your mouse pad to make sure your wrists are supported and in line with your forearms.
  11. Bring your keyboard down: It's best to avoid reaching up to type, so use an adjuster that allows you to type at a more relaxed level.
  12. Consider a slightly reclined position: A good ergonomic chair will allow you to lean back slightly, which relaxes your back muscles and decreases pressure on your lower back.
Sleeping
Believe it or not, sleeping in the correct position also benefits your health, can prevent injury and will help you maintain good posture habits when you're awake, too. Check out this list for sleep-related ergonomics.
  1. Keep your pillow under your head: It sounds obvious, but pillows are meant to support your head and neck, so don't sleep without ample support under them.
  2. Add another pillow between your legs: If you like to sleep on your side, put a pillow between your legs, and slightly draw them up from your hips.
  3. Use the right pillow: The right pillow should cradle "your head in the same relation to your shoulders and spine as if you were standing with correct upright postures," according to the Better Sleep Council, via nwhealth.edu.
  4. Don't sleep on your stomach: This rule is especially important if your mattress is weak, as sleeping on your stomach causes back strain.
  5. Get up correctly: Don't just roll out of bed. Avoid cricks and muscle cramps by first turning on your side and pulling up your knees, swinging your legs over the side of the bed. Push yourself up from the sitting position by pushing down on the bed.
Studying
Libraries, study centers and your dorm couch aren't necessarily designed with ergonomics in mind, so you'll have to make some adjustments. Here are tips for DIY ergonomics.
  1. Bring a pillow or bolster: A small pillow, cushion or bolster will do wonders for your sitting or reclining position and will keep you comfortable for longer periods of time.
  2. Watch the weight of your backpack or messenger bag: A purse or book bag that's too heavy will cause great strain and even injury to your shoulder, neck, and/or back. Try switching the way you carry your bag every once in a while, and only carrying what you really need.
  3. Take better notes: Adjust your note-taking habit so that you keep your fingers relaxed, move your writing paper to the correct position, and write in cursive instead of printing.
  4. Don't bring your laptop to bed: Balancing your laptop on your bed will cause you to hunch over and strain your neck, so leave it at your desk.
  5. Choose the right ebook: If you're lucky enough to use an ebook in college, choose the edition that has the best ergonomic improvements and that won't cause eye strain.
Exercises
Try out these exercises and stretches to give your body a break and work out some of the tension.
  1. Shoulder blade squeeze: Lift your arms straight out in front of you, then swing them out towards your back as far as you can go, without over-straining yourself. Bring them forward again and repeat a few times.
  2. Crunches: Anything that works out your core -- including crunches -- will help support your back.
  3. Stretch everything: Take little breaks to stretch everything, including your facial muscles and fingers.
  4. Work out your hands and palms: Fold your hands together, face your palms away from your body, and stretch your arms in front of you. Repeat up to eight times.
  5. Knee Kiss: As you pull one leg at a time up to your chest (or lips), hold it with both hands and hold for five.
  6. Superman: To do the Superman, lie face down on the floor, and lift your right arm and left leg off the floor. Hold for a few seconds, and then switch arms and legs.
  7. Quadricep stretch: Scoot your chair back so that you can stretch out your legs in front of you, and hold for five.
  8. Neck and shoulder stretch: Roll your shoulders back, and then drop your head so that your chin nearly rests on your chest. Move your head to the right, then to the left.
Identifying Risks and Injury
Here you will learn some potential risks for injury like carpal tunnel.
  1. The scrolling wheel: Overusing the scrolling wheel on your mouse can actually lead to pain and discomfort, so choose to click instead.
  2. Don't cradle your phone with your neck: If you spend time on the phone while you work or study, hold it properly with your hand, and not by cradling it with your neck.
  3. Monitor your B12 intake: Ergoblog reports that B-12 deficiencies, which can be common among college students who aren't vigilant about their diet, can lead to tingling feelings in muscles and hands, which is similar to carpal tunnel symptoms.
  4. Watch your caffeine and smoking too: this report shows that caffeine and smoking make carpal tunnel symptoms worse because they slow blood flow.
  5. Understand the difference between cumulative trauma and repetitive stress injuries: Visit a doctor so that he or she can help you correctly identify your injury and a rehab solution.
Miscellaneous Tips
From using a footrest to taking frequent breaks, here are more ergonomics tips for students like yourself.
  1. Take breaks: Ease eye strain and repeated muscle movement by getting up to walk around the room and stretch a couple of times every hour, at least.
  2. Use a footrest or seat cushion: If you're short, ensure that your computer desk posture is correct by using footrests and cushions to keep you at the right height.
  3. Test your posture: You can test your standing posture by standing with your head, rear end, and shoulder blades pressed against a wall. You should have one hand's thickness between your back and the wall.
  4. Know how to lift your laundry: If you like to go weeks without doing laundry, don't try to pick up the entire heavy load at once. Try lifting a few loads, and make sure you bend at the knees, not at the waist, and use your leg muscles to stand up.
  5. Use a checklist: Use this checklist to make sure your workstation has all the right components for promoting good posture.

Mind Level Of Chartered Accountants

A CA walks into a bank in New York City & asks for a $5000 loan. The Bank asks for a security & the CA hands over the keys & documents of his BMW which is parked on the streetin front of the bank. After all the necessary check the Bank agree to grant him loan.

The Bank president & all officers enjoy a good “laugh” for CA for using &100000 BMw as collateral against a loan of $5000. Then the car was parked in the banks garage safely.

2 weeks later the CA returns & repays $5000 loan & the interest which comes to $15.41. The bank officer says, “Sir we are very happy to do transaction with you but we are a little puzzled. While you were away, we checked out & found that you are a “multi-millionaire” , then why did you bother to borrow $5000?

Then the CA replies, “where else in New York city can I Park my car for 2 weeks for only $15.41 & expect it to be thr when I return!!!!

Eligibility for Giving CA Final May 2011 Exam


The students who desire to appear in the Final Examination to be held in May 2011 and onwards hereby informed that a relaxation has been provided under relevant Regulation with regard to their articleship training as under:-

“ a candidate who is otherwise eligible to appear in the Final Examination shall not be required to be in service of articles/audit training on the first day of the month in which the final examination is held. However, such relaxation shall be confined only to first of such permissible examination (i.e., the Final Examination in which a student shall become eligible to appear in the Final Examination for the first time only but not thereafter), irrespective of whether he is from the stream of Professional Education Examination – II(PEE-II) or Professional Competence Examination(PCE) or Integrated Professional Competence Examination (IPCE) under the provisions of Regulation 29 C of the Chartered Accountants Regulations 1988.”

It may be noted that in the Application Form for May 2011 Final Examination, it was mentioned that the aforesaid benefit is applicable to candidates who had passed Professional Education Examination – II (PEE- II) Examination. With the above decision, all candidates (PCE as well IPCE) are eligible to get this benefit.
